1. Acceptance
By accessing the Foodarian website or placing an order you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service. Foodarian LLC may update these Terms at any time; continued use constitutes acceptance.
2. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm that all information you provide is accurate and that you are authorized to use the payment method.
3. Ordering and acceptance
Foodarian is a delivery-only service. Orders are placed as a guest; no account is created. An order becomes binding when payment is confirmed on our payment page. We reserve the right to refuse or cancel any order, e.g. due to product unavailability, address outside our delivery area, or suspected fraud, in which case any payment received will be refunded in full.
4. Prices, fees and payment
All prices are shown in U.S. dollars and may change without notice. Delivery is free of charge. Promotional discounts (such as the grand-opening 30% discount) are applied automatically at checkout and may be withdrawn at any time. Applicable taxes are calculated at checkout where required. Payment is processed by a third-party provider on its own secure page; you agree to that provider's terms.
5. Delivery
Estimated delivery times (typically 20–30 minutes) are estimates, not guarantees. You are responsible for providing a complete and correct address and for being available to receive the order. If a delivery fails because of incorrect information or absence, the order may be treated as fulfilled.
6. Allergens and food safety
Our kitchens handle nuts, gluten, dairy, eggs, soy, sesame, fish and shellfish. Ingredient lists and nutrition values are indicative. If you have a severe allergy, contact us before ordering. Consume delivered food promptly.

See our Refund Policy for details. Because food preparation begins immediately, orders generally cannot be cancelled once accepted by the kitchen.
8. Intellectual property
All content on the website — text, images, logos, layout and code — is owned by or licensed to Foodarian LLC and protected by U.S. copyright and trademark law. You may not reproduce it without written permission.
9. Disclaimer and limitation of liability
The service is provided 'as is'. To the maximum extent permitted by law, Foodarian LLC disclaims all implied warranties and shall not be liable for indirect, incidental or consequential damages. Our total liability for any claim relating to an order shall not exceed the amount paid for that order.
10. Governing law and disputes
These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law principles. Any dispute shall first be attempted to be resolved informally by contacting [email protected]; unresolved disputes shall be submitted to binding individual arbitration under the rules of the American Arbitration Association, except where prohibited by law.
